1. Acceptance of Terms
By accessing this website, creating an account, submitting a judgment, using our portal, or interacting with our services, you agree to be bound by these Terms of Service and all related policies including the Privacy Policy, Cookie Policy, Regulatory Compliance Statement, Disclaimers Page, and Data Processing Addendum.
If you do not agree, you must stop using this website immediately.
2. Nature of Our Business
Great Lakes Recovery Solutions operates exclusively as a judgment purchaser and assignee, not as a collection agency.
This means:
- You submit your civil judgment to us for evaluation.
- If approved, you assign or sell the judgment to us using legally valid assignment documents.
- Once legally assigned and filed with the court, we become the judgment creditor of record.
- We enforce the judgment in our own name, for our own benefit.
- You are not hiring us, and we do not represent you.
This model is recognized and legally distinct from third-party debt collection.
3. Nationwide Operation
We accept, evaluate, and enforce judgments from all 50 U.S. states, U.S. territories, and the District of Columbia, subject to legality in each jurisdiction.
Enforcement Location
Judgment enforcement occurs in the state and court where the judgment was originally awarded, in accordance with that state's:
- Civil procedure
- Garnishment laws
- Exemption rules
- Filing requirements
- Court deadlines
- Sheriff/constable policies
Contract Location
All contracts (e.g., Terms of Service, assignment agreements, platform usage agreements) are governed by:
State of Michigan law (excluding its conflict-of-law rules)
This dual-structure ensures both:
- Legal consistency for your business agreements
- Compliance with each jurisdiction's enforcement laws
4. Eligibility to Submit Judgments
To submit a judgment for evaluation:
- You must be the legal judgment holder
- You must be at least 18 years old
- You must provide truthful, complete information
- You must have the legal authority to assign the judgment
- You may submit judgments from any U.S. state
We reserve the right to accept or reject any judgment at our sole discretion.
5. Assignment of Judgment
A judgment becomes our property only after:
- You sign the Assignment of Judgment and Purchase/Assignment Agreement
- The document is notarized
- We file the Acknowledgment of Assignment with the correct court
- The court records our assignment
Once assigned:
- The transfer is irrevocable and without recourse
- All rights, title, and interest pass to us
- You relinquish all authority to collect
- We gain sole authority to enforce, settle, compromise, or pursue the judgment
- You may not interfere with enforcement
- Any payments you receive after assignment must be forwarded to us
Assignments are valid in every state, subject to that state's assignment laws.
6. No Legal Representation
We do not provide:
- Legal advice
- Legal representation
- Attorney-client services
- Court strategy advice
You are not our "client." You are simply a party assigning or selling a judgment.
7. Multi-State Compliance and Procedures
We follow:
- The enforcement rules of the awarding state
- Federal Rule of Civil Procedure 5.2 (privacy)
- State privacy and data regulations
- Civil enforcement statutes
- Sheriff/constable policies
- Garnishment and exemption laws specific to each state
You acknowledge:
- Each state handles judgment enforcement differently
- Timelines, costs, and procedures vary
- We cannot guarantee any enforcement action will succeed
8. Payments to Former Judgment Holders
If your agreement states you will be paid from proceeds collected:
- Payments occur only after funds clear
- Court fees, sheriff fees, banking fees, skip-trace costs, and enforcement expenses are deducted first
- Payments are calculated per your Assignment/Purchase Agreement
- We do not guarantee collection or the amount of proceeds
- We do not pay advances
9. Debtor Payment Portal
Debtors accessing the system agree to:
- Provide accurate information
- Make payments in full and on time
- Understand that partial payments do not guarantee release unless the full judgment balance, interest, and costs are satisfied
Returned payments, bank fees, and processing failures may incur additional charges as permitted by law.
10. Prohibited Conduct
Users may not:
- Submit fraudulent judgments
- Forge court documents
- Submit information they know is inaccurate
- Access or attempt to access debtor data unlawfully
- Interfere with the portal or website
- Misuse assigned documents
- Initiate legal action in our name
We may suspend or terminate accounts for violations.
11. Data Practices
Your usage is governed by:
You agree:
- To never misuse debtor information
- To never attempt to access restricted systems
- That we process data as required for enforcement and legal compliance
12. No Guarantee of Outcome
We make no promises regarding:
- How much will be collected
- How long enforcement will take
- Whether a debtor will have assets
- Whether court orders will be issued
- Sheriff/constable execution success
- Employer or bank compliance
- Accuracy of third-party data
13. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, exemplary, or consequential damages
- We are not liable for court errors, sheriff delays, filing rejections, or garnishment failures
- We are not liable for losses caused by debtor insolvency, bankruptcy, or exemptions
- Your exclusive remedy is limited to the amount you were contractually entitled to under your Assignment Agreement
14. Governing Law & Jurisdiction
Contracts
All contracts, including these Terms of Service, are governed by the laws of the:
State of Michigan
Enforcement
Judgment enforcement is governed by the laws of the state where the judgment originated.
Venue
Any disputes arising from the contract, not the underlying judgment, must be litigated exclusively in:
Michigan courts (state or federal).
15. Modifications
We may update these Terms at any time. Continued use of the site constitutes acceptance of updated terms.
